Supreme Court’s Denial of The 9/11 Families’ Petition

Monday, June 29th, 2009

In Response to the Supreme Court’s Denial of The 9/11 Families’ Petition for Writ of Certiorari
On Behalf of The 9/11 Families United to Bankrupt Terrorism

(In Re: Thomas E. Burnett, Sr., et al. v. Al Baraka Investment & Development Corp., et al., Case No. 03-CV-9849 (GBD); In Re: Terrorist Attacks on September 11, 2001, 03 MDL 1570)

WASHINGTON, June 29 /PRNewswire-USNewswire/ — The following is a statement on behalf of the 9/11 Families United to Bankrupt Terrorism:

We are deeply disappointed that the U.S. Supreme Court has denied our petition for writ of certiorari, thus deciding not to hear our appeal of a lower court’s decision to dismiss our charges against five Saudi defendants we allege provided material support for the September 11, 2001 attacks.

The High Court’s decision only further denies us our day in court, while enabling members of the ruling family to evade accountability. We respect the Supreme Court as the ultimate arbiter of legal matters in our system of government; nevertheless, we find this result a travesty of justice and a betrayal of the 9/11 families and others whose lives are impacted by terrorism.

In a sad day for justice, the Saudi ruling class’ interests have been advanced at the expense of the rights granted to civil litigants under our Constitution and the laws designed by Congress to deter terrorism such as the Anti-Terrorism Act, 18 USC 2331 et seq. We believe the High Court’s decision sets a dangerous precedent that those who provide support to terrorism atrocities will now see themselves as beyond the reach of U.S. laws. The High Court’s decision allows fundamental questions of law to go unresolved, and lets stand a decision by the Second Circuit that the Department of Justice itself believes to be wrong, potentially affording terrorism sponsors undeserved protection from accountability in ongoing and future cases. We will continue to do everything within our rights to stop the material support pipeline fueling al Qaeda and to press our remaining claims in the case.

Hearts and Hands and the Listing of Victims’ Names

Sunday, June 28th, 2009

To All,

Below is an article from Friday’s Downtown Express about how the names will be listed at the WTC Memorial. Please take a moment to read.

As you know we have been working on the Hearts and Hands Memorial for over 6 years.

In the Hearts and Hands Memorial we will have a Corridor of Memories.

The corridor will contain 8×10 photos of all the victims of 9/11

These photos will be arranged in alphabetical order within affiliation

Under each photo will be the victim’s name (as requested by the victim’s family)

If they want a rank or other designation or even a nickname it will be included.

We will also include the age of the victim as well as the location of the victim on 9/11.

We have been taking feedback from the families as we want this memorial to be a personal as possible.

We feel that the Corridor of Memories along with an exhibition hall in which the United in Memory 9/11 Victims Memorial Quilt will be permanently displayed and a 21,000 square foot Memorial Garden will achieve this goal.

This along with the fact that visitors will be able to record or listen to messages as well as the fact that visitors will have access to an interdenominational chapel should give family members everything they have been asking for.

We currently have the support of most of the 9/11 Family Groups, the Uniformed Unions as well as most of our local elected officials.

We will be meeting with the WTC Memorial Foundation this week to once again present our plan to them.

We hope this time they will listen.

If you have not sent in an 8×10 photo please do so.

Photos should be sent to

Final Request for Photo of loved one for Seattle Law School documentary

Monday, June 22nd, 2009

Dear 9/11 Families,

I am writing with a very special request.

This e-mail is to ask you to participate in a unique, non-profit, educational documentary film. I am a Professor at Seattle University producing Out of the Ashes: 9/11, a film about 9/11 families and their experiences with the 9/11 Victim Compensation Fund (VCF) and the 9/11 Federal Court lawsuits.

Request for Photo

I am requesting a photo of your loved one to be used in this documentary. I will be honoring the deceased victims of 9/11 by scrolling the names and photos at the beginning and at the end of the documentary. I would be honored to feature as many photographs as I receive.

The Documentary: “Out of the Ashes: 9/11”

The documentary is a 501 (c) (3) non-profit educational project sponsored by Seattle University, a Catholic-Jesuit institution. The documentary will be distributed to universities, colleges and secondary schools. This is not a commercial endeavor. Proceeds, if any, will be donated to charities. Our professional production is directed by an Emmy-award winning filmmaker, and is filmed in the high quality HD.

The documentary portrays seven 9/11 families and their struggle to cope with the terrorist tragedy and their experiences with the Fund and litigation. Among the families are a father of a NYC firefighter; a Flight 93 pilot’s widow; families who lost loved ones in both WTC towers and on the ground; and a victim of the toxic dust at Ground Zero. The film is objective, giving a voice to the families and provides a dignified analysis of the issues: skyscraper safety, proper burial for 9/11 victims, the toxic dust (respiratory diseases and deaths), fairness of the Fund and the 9/11 Federal Court litigation.

The VCF has been cited as the model of an alternative to civil litigation. This documentary takes an unbiased look at the VCF vs. litigation with the goal of being used as a teaching tool in hopes of learning lessons.

To Participate

If you would like to participate, please send a photo of your loved one as an e-mail attachment directly to me at: marilynjberger@gmail.com.

If you prefer to mail your photo, please send it to:

The New York State Workers’ Compensation Law has just been changed to help you file a claim for workers’ compensation if you have a 9/11- related illness.

Monday, June 15th, 2009

The New York State Workers’ Compensation Law has just been changed to help you file a claim for workers’ compensation if you have a 9/11- related illness.

The change also applies to workers and volunteers who are not sick, but who may become sick in the future because they were exposed to the toxic air after 9/11.
Thousands of people who participated in rescue, recovery or cleanup work after 9/11 are now sick. Many more may become sick as a result of exposure to contaminated dust and smoke. The New York State Workers’ Compensation Law has been changed to allow someone who was exposed, but is not sick, to register. Registering now will protect your right to file a workers’ compensation claim if you become sick at any time in the future. The law also allows anyone who already filed a claim – but was turned down because the claim was filed too late – to re-file. If you do not register and are sick or become sick later, you will not be able to file or re-file a claim.

Workers’ compensation pays all the medical expenses for a sickness or an injury that is work-related. It also pays two-thirds of your average weekly wage up to the current maximum of $500, if you cannot work because of work-related sickness or injury.
Even if you are now healthy, but were exposed to contaminated air after 9/11, you must register now with the Workers’ Compensation Board to protect your right to file a claim if and when you become sick.
Who is eligible to apply for 9/11-related workers’ compensation or to register?
Most people who did rescue, recovery or cleanup work, either as a volunteer or for pay, between Sept. 11, 2001 and Sept. 12, 2002
• anywhere in Manhattan south of Canal or Pike Streets, or
• on the barge operation between Lower Manhattan and Staten Island or
• at the Staten Island landfill or
• at the New York City morgue.
There are some workers who are not eligible because they are not in the workers’ compensation system. They are NYC uniformed services (firefighters, police, sanitation workers), NYC teachers and federal employees. But those workers are eligible if they performed any rescue, recovery or cleanup work off-duty, as a volunteer.
Why must you register, even if you are not sick?
Rescue, recovery and cleanup workers who are now healthy should register because people who are registered can apply for workers’ compensation if they develop a 9/11-related illness at any time in the future. Failure to register during the enrollment period will prevent you from ever receiving workers’ compensation benefits, even if you do develop a 9/11-related illness. If you performed rescue, recovery or cleanup work below Canal Street or at the other locations listed above, you must register now to protect your rights to Workers’ Compensation benefits.
When is the deadline to register?
The deadline for registering is September 11, 2010. If you do not register before the deadline, you will never be able to collect workers’ compensation if you develop a 9/11-related illness later.
What about rescue, recovery or cleanup workers who are sick now?
If you are already sick you can file a claim for workers’ compensation immediately after registering.
Are volunteers who did rescue, recovery or cleanup work eligible?
Yes. This program applies both to paid workers and to people who worked as volunteers. The law specifies that all volunteers are eligible, but it does not define “volunteer.” Since the definition of volunteer may not be settled before the end of the enrollment period, people who performed any rescue, recovery or cleanup work for no pay should register.
Does a worker or volunteer who has already established a workers’ compensation claim need to register?
Yes, because if you develop a new 9/11-related condition in the future, your existing claim will not cover the new condition. If you register now, you will be eligible to file a new claim any time in the future.
What about workers who already filed a workers’ compensation claim, but were rejected?
If you were rejected because you missed the filing deadline, you are eligible to register and then file a new claim.
Are people who did cleanup in Lower Manhattan, but not at the World Trade Center eligible?
Yes. You are eligible if you did rescue, recovery or cleanup work anywhere in Lower Manhattan south of Canal Street or south of Pike Street.
Is this program limited to people who worked in Lower Manhattan?
No. It also applies to anyone who worked in connection with the barge operation between Lower Manhattan and Staten Island, anyone who worked at the Staten Island landfill and to anyone who worked at the NYC morgue.
Is a person who was only exposed to WTC contamination in 2003 eligible?
No. To be eligible, you must have been exposed while performing rescue, recovery or cleanup work between Sept. 11, 2001 and Sept. 12, 2002.
How does a person register?
On the Internet, go to www.nycosh.org and click on the link near the top of the page. Or call 1-866-WTC-2556 to request a form. On the form, you must write the dates and locations of the rescue, recovery or cleanup work you did and the name of your employer, or the organization you volunteered with. If you did rescue, recovery or cleanup work for no pay, you should register as a volunteer, even if you were not a part of an organized group of volunteers, giving the details of the work you performed. The registration form must be a sworn and notarized statement, so it is very important to make certain it is accurate and complete.
What about someone who is not in New York State?
If you are eligible to register or to file a workers’ compensation claim, you should do so. It does not matter if you are now out of state or even out of the country.
What happens if I register now and become sick in the future?
When you become sick, you must file all of the forms required by the WCB to establish a claim.
What kind of illnesses are covered?
Any illness caused by 9/11-related exposure, including mental conditions such as post-traumatic stress disorder.
Will someone who registers have difficulty getting health insurance?
Probably not. The names of people who register are confidential, to be used only by the Workers’ Compensation Board, except that the Board informs a workers’ employer about the claim.
Is an undocumented worker eligible to register or receive workers’ compensation?
Yes. The law is clear that your immigration status does not affect your right to workers’ compensation.
What does a person who is eligible and files a workers’ compensation claim get?
Workers’ compensation pays 100 percent of the cost of medical care for a work-related injury or illness. If you are unable to work because of the injury or illness, workers’ compensation pays 2/3 of your weekly wage up to the current maximum of $500.
Do I need a lawyer to register?
No, you can register without a lawyer, but if you have concerns about details of your case, you should consult someone who is familiar with this 9/11 workers’ compensation program or with a lawyer. If you belong to a union, contact your union representative before selecting a lawyer, because your union may be able to refer you to a law firm that is familiar with issues faced by members of your union. For a list of workers’ compensation lawyers in New York State, contact the Injured Workers’ Bar Association at www.injuredworkersbar.org or call 845-454-9700
For a registration form and instructions, go to www.nycosh.org or contact NYCOSH at 1-866-WTC-2556.

FAMILY MEMBERS TO PARTICIPATE IN CREATION OF MEMORIAL EXHIBITION

Wednesday, June 10th, 2009

To All,

I am forwarding this on because I have made a commitment to pass on all 9/11 information and I really do want the memorial/museum at Ground Zero to succeed.

That being said I find it very disheartening that for the past five years we have asked the mayor and the World Trade Center Foundation to assist us with the hearts and Hands Memorial.

A Memorial that is going to include 8 x 10 photos of all the 9/11 Victims in a corridor of memories that will also allow family members to record memories.

Our numerous e-mails and letters have gone unanswered and now we receive this. (attached please find latest letter)

We are moving forward with the Hearts and Hands Memorial an along with our Corridor of Memories we will house the United in Memory 9/11 Victims Memorial Quilt and a 21,000 square foot memorial garden..

We hope that you will continue to support our effort to complete this project by 9/11/11.

NATIONAL SEPTEMBER 11 MEMORIAL & MUSEUM INVITES VICTIMS’ FAMILY MEMBERS TO PARTICIPATE IN CREATION OF MEMORIAL EXHIBITION
Family Members Contributions of Objects, Text, and Recorded Memories to Make Up Content for Exhibition Honoring Each Individual Life Lost;
Outreach Effort Begins to Verify Listing and Arrangement of Memorial Names

The National September 11 Memorial & Museum today began inviting 9/11 victims’ family members to contribute objects, text and recorded memories that will make up the content of one of the Museum’s key exhibitions — the Memorial Exhibition. The Memorial Exhibition will allow visitors to the Museum to learn more about each individual who was killed in the September 11, 2001 and February 26, 1993 attacks. The Memorial & Museum also began an important outreach effort to verify the listing and arrangement of each victims’ name for the 9/11 Memorial.

“We are asking those who knew these individuals best — their family, friends, and colleagues — to help ensure that the memory of each person is preserved through the Memorial Exhibition,” 9/11 Memorial President Joe Daniels said. “Objects, photographs, recorded memories and text will create moving portraits that celebrate each individual life and allow visitors to relate to those who died.

“The next-of-kin’s participation in arranging and verifying the names to be inscribed on the Memorial is vitally important. We plan to work with the information provided by families to place the names in a meaningful way that recognizes relationships and friendships,” Daniels said.

“The Memorial Exhibition will underscore the value we place on individual lives,” 9/11 Memorial Museum Director Alice M. Greenwald said. “The thousands of faces and memories demonstrate the impact of terrorism on individuals, families and communities. The exhibition clearly shows that terrorism is not an abstraction, reinforcing a core message of the Memorial Museum - that the indefensible acts of terrorism affect real people.”

The Museum’s goal is to collect at least one photograph or portrait image for each person killed in the 2001 and 1993 attacks, as well as written and oral remembrances, commemorative text and personal objects, in order to develop the Memorial Exhibition and build a robust, accompanying biographical archive. There are a number of ways that the public, whether parents, siblings, spouses, co-workers, or friends of victims, can contribute.

Images, written remembrances, and commemorative text can now be submitted through a new special section on the Memorial & Museum website, http://newmuseumme.national911memorial.org/. Contributors to the website will be able to create unique profiles to upload images, digital files, and text that can be continually accessed by the contributor and will become part of the Museum’s permanent collection. This material can also be submitted by mail.

In addition, the public can share images and text about their loved ones through the “9/11 Living Memorial” project, an interactive, digitized, and searchable database designed to commemorate individual lives and stories, that will be a central component of the Museum’s archive. The Memorial & Museum has established an official collaborative partnership with leading family advocacy group VOICES of September 11th to support the “9/11 Living Memorial.”

The Memorial & Museum has also launched a new feature, the “Call to Remember” initiative which allows people to record 10-minute remembrances about their loved ones by phone at (866) 582-5613 (toll free) or (646) 248-6225 (local). Callers are encouraged to imagine that they are speaking with a friend and to share information that will help others to understand the individual who died. Remembrances can be recorded in any language.

The “Call to Remember” initiative uses web services provided by Twilio, a company headquartered in San Francisco, California, which supplies telephony infrastructure web service “in the cloud”, enabling web programmers to integrate phone calls into their applications. With Twilio, developers can initiate and receive real-time phone calls using existing web application frameworks such as PHP, Java, .NET, Python, Ruby, C#, ASP, and more.

Excerpts from the “Call to Remember” oral remembrances, as well as from the Memorial & Museum’s oral history program and a partnership with the national spoken history initiative StoryCorps, will be a core component of the Memorial Exhibition and will be used to support other Museum exhibitions.

The Memorial Exhibition will commemorate the lives of those who perished on September 11, 2001 and February 26 1993, and will provide visitors with the opportunity to learn about the men, women, and children who died. The Museum plans call for visitors to enter the exhibition along a corridor in which nearly 3,000 victims’ photographs form a “Wall of Faces,” intended to communicate the scale of human loss. Nearby, interactive tables will allow visitors to discover additional information about each person, including photographs, recollections by family and friends, artifacts, and the location of individual names on the Memorial pools. Rotating selections of personal artifacts will also be featured. An adjoining chamber will present profiles of individual victims in a dignified sequence, through photographs, biographical information, and audio recordings.

The Museum is currently developing a primary interpretive exhibition that will focus on what happened on September 11, 2001, how these events transpired, and detail the extraordinary response — locally, nationally, and internationally. The exhibition will allow visitors to contemplate what it means to live in a “post-9/11 world.” Powerful artifacts, ranging from the monumental to the intimate; documentary photographs and film footage; and first-person narratives will combine to relate a story of tragedy and survival, and of selflessness and courage.

The Museum will also incorporate as exhibition elements a variety of existing materials that encompass an extraordinary range of size, weight and media. These include: remnants of the World Trade Center structures attesting to the enormity of the buildings and the forces of destruction—multi-ton pieces of steel currently in the care of The Port Authority of New York and New Jersey; intimate mementos that mark individual experiences; paper-based and mixed media materials detailing some of the aftermath of the events; vast collections of photographic, video and born-digital imagery by both amateurs and professionals; oral histories and other audio materials; artistic expressions made in tribute to the lives lost and to the events and their emotional impact; and in-situ physical remnants of the site including the surviving Slurry Wall and the truncated box column remnants.

The Museum’s exhibitions are currently in design development. In April 2007, Thinc Design, Inc., in partnership with Local Projects, LLC, was chosen as the lead exhibition design firm for the Memorial Museum.

To download new renderings of the Memorial Exhibition, visit www.national911memorial.org/renderings.

Outreach Effort Begins to Verify Listing and Arrangement of Memorial Names

The Memorial & Museum is asking the next-of-kin of each victim to participate in the important process of ensuring that all names are inscribed correctly on the 9/11 Memorial. Over the next month, the next-of-kin of each victim should receive an official Memorial Name Verification and Arrangement package in the mail that includes a form to verify the inscription of the name and to provide other information that will help to guide the arrangement.

The names of the nearly 3,000 victims will be inscribed on bronze parapets surrounding the Memorial pools, which sit in the footprints of the Twin Towers. The Memorial pools will each be nearly one acre in size. The names will be stencil-cut into the parapets, allowing visitors to look through the names at the water and to create paper impressions or rubbings of individual names. At night, light will shine up through the voids created by each letter.

Names placed around the North Pool will include those who worked in or were visiting the North Tower (1 WTC); crew and passengers of American Airlines Flight 11; those who were killed in the February 26, 1993 bombing at the World Trade Center.

Around the South Pool, names will include those who worked in or were visiting the South Tower (2 WTC) and all other areas of the World Trade Center complex and surrounding areas; crew and passengers of American Airlines Flight 175; those who worked in or were visiting the Pentagon; crew and passengers of American Airlines Flight 77; crew and passengers of United Airlines Flight 93.

Within these groupings, the names of those who shared the same affiliation will be inscribed together (such as co-workers from the same company, flight crew of the planes, or people visiting the Towers together). Additionally, the forms being sent to the next-of-kin will ask if there are specific victims’ names they would like to be inscribed adjacent to their loved ones — whether family members, friends, or co-workers.

Visitors to the Memorial will be able to locate individual names through on-site kiosks, staff and volunteers, online websites, and printed directories.

ABOUT THE NATIONAL SEPTEMBER 11 MEMORIAL & MUSEUM

The National September 11 Memorial & Museum is the not-for-profit corporation created to oversee the design, raise the funds, and program and operate the Memorial & Museum at the World Trade Center site. The Memorial & Museum will be located on eight of the 16 acres of the site.

The Memorial will remember and honor the nearly three thousand people who died in the horrific attacks of February 26, 1993, and September 11, 2001. The design, created by Michael Arad and Peter Walker, consists of two pools that reside in the footprints of the original Twin Towers, surrounded by a plaza of oak trees. The Arad/Walker design was selected from a design competition that included more than 5,000 entrants from 63 nations.

The Museum will display monumental artifacts associated with the events of September 11, while presenting intimate stories of loss, compassion, reckoning and recovery that are central to telling the story of September 11 and its aftermath. It will communicate key messages that embrace both the specificity and the universal implications of the events of 9/11; document the impact of those events on individual lives, as well as on local, national, and international communities; and explore the continuing significance of these events for our global community.

Donations can be made through and more information can be found at the Memorial & Museum’s website, http://www.national911memorial.org/, or by calling 1-877-WTC-GIVE.

ANOTHER IMPORTANT CALL: 9/11 Day of Service

Wednesday, June 3rd, 2009

Friends,

Thanks to all your help, we secured passage of the legislation establishing 9/11 as a National Day of Service. NOW WE HAVE ONE FINAL HURDLE — CONGRESSIONAL APPROPRIATIONS.  Although the legislation has passed, Congress still can choose not to fund the program, something they do all the time!  Often that can be good policy, but not in our case. We need Congress to authorize the very modest funding we have requested so that we can implement the program ASAP and start preparing for the 10th anniversary of 9/11, which is in 2011.

You can help by making one more call, to Representative David Obey, chairman of the Appropriations Committee that will begin considering our request next week. His Washington DC office telephone number is:  202-225-3365.  PLEASE MAKE THE CALL AS SOON AS YOU CAN BEGINNING TOMORROW. His committee will begin reviewing appropriation requests early next week. You can say:

“My name is ________________, and I (add something about your background, interest or where you live).  I’m calling to urge Chairman Obey and the Committee on Appropriations to support the request for full funding of the September 11 National Day of Service and Remembrance. This request is absolutely vital to establishing 9/11 as a National Day of Service in America.  We need this observance to ensure that America forever remembers the events of 9/11, and as a way to pay lasting tribute to the victims, as well as the first responders, rescue and recovery workers, volunteers and military personnel who rose to service in response to the 9/11 attacks on our nation. I would greatly appreciate it if you would please pass along my message to Rep. Obey.  Thank you.”

We have great support among members of the Committee, but as Chairman, Representative Obey will ultimately play a major role in deciding whether the 9/11 program is funded.

Thanks again…we are very close!

HEARTS AND HANDS UPDATE 6/1

Monday, June 1st, 2009

Dear Friends,

Plans are moving along for the Hearts and Hands 9/11 Memorial.

We got some really good footage during our last visit to the site and

will be putting together something that we will share with you shortly.

We will also be submitting our still photos this week and finally free up

the balance of our startup grant.

Once we get access to those funds we will begin cleanup of the site.

We have not heard anything back from Mayor Bloomberg or anyone from the

WTC Memorial Foundation so it appears we will have to move forward

without their involvement.

I will be making arrangements for another walkthrough of the site for

our local elected officials and I will also extend an invitation to

representatives of our 9/11 family groups to give them all a firsthand

look at the site.

We will also be reaching out for initial quotes for structural engineers

for a preliminary assessment of the structures.

Finally we will be working with our architects to create a virtual tour

of the sites which will allow you to walk through the site as it exists

today as it morphs into what it will become.

I am working with Bill Doyle to obtain additional 8 X 10 photos for our

Corridor of Memories but we still need to get the word out to all family

members.

Photos should be mailed to

Please include

Location and Employer on 9/11

Date of Birth

Throughout we will be scheduling interviews with family members as well

as people who have been involved with this process over the past 8

years.

We are also looking to have the United in Memory 9/11 Victims Memorial

Quilt on display the weekend of 9/11 this year.

We are still looking for your financial support.

Without the mayor’s support we will have to raise $1 million through

individual contributions.

We hope to raise the balance from local government support and corporate

contributions once we start our formal fundraising campaign in

September.

Tax deductible contributions at any level can be sent to Where to Turn

at the address above.

Face book members can donate through the Hearts and Hands cause at
